New Year’s Day in Zambia
New Year’s Day is listed in Zambia’s Public Holidays Act as a public holiday observed throughout the country. The Act sets 1 January as the holiday and provides for the following Monday to be observed when a listed holiday falls on Sunday.[1]
A nationwide holiday under Zambian law
The Public Holidays Act includes New Year’s Day in its national schedule. It says scheduled holidays are observed throughout Zambia, so the holiday’s specific connection to Zambia is its countrywide legal status rather than a regional designation.[1]
The Act also allows the Minister to declare additional public holidays by statutory notice. New Year’s Day, however, is already named in the Act’s schedule; it does not depend on an annual declaration to be recognized as a public holiday.[1]
Sunday observance and employment rights
Under the Act, when a scheduled public holiday falls on a Sunday, the following Monday is observed as a public holiday. This is the statutory substitute-day rule; it does not move the fixed New Year’s Day date of 1 January.[1]
A public holiday and a paid day off are related but distinct questions in the Employment Code Act. Section 35 says the Minister may designate a Public Holidays Act holiday as a paid public holiday. For an employee to receive the Code’s full-pay entitlement for that day, the section also sets a condition concerning absence without permission or reasonable excuse on the working day immediately before or after it.[2]
The Code addresses employees and provides a separate wage rule for an employee who works on a public holiday that is outside the employee’s normal working week: the employer must pay double the employee’s hourly rate. The Code excludes members of the Zambia Police Service, Correctional Service and Security Intelligence Service, among others, from its general application; service-specific rules may therefore matter for those groups.[2]
What to expect in daily life
The Public Holidays Act establishes nationwide public-holiday status and the Sunday rule. It does not, by itself, specify that every government office, bank, shop, restaurant or transport service must close, or set holiday operating hours for them.[1]
For practical plans, check the relevant office, bank, shop or transport operator directly. Employees can check their contract, applicable workplace arrangements and current paid-holiday designation, since the Employment Code describes how paid status and work on a holiday are treated.[2]
