The Employment (Annual and Public Holidays) Order sets out different provisions depending on whether an employee is required to work. A qualifying employee who is not required to work on a public holiday is entitled to a day’s holiday pay; an employee required to work may receive a day off in lieu or additional pay under the Order’s conditions. This does not mean every worker is automatically off duty.[2]
