Legal status and pay

The Employment Act 2000 BES recognizes both Easter days as public holidays across the Caribbean Netherlands. Under the Act, an employee retains entitlement to at least the wages they would have earned during their normal working hours on a public holiday. An employee who performs scheduled work that day is entitled to at least twice those wages.[2]

The government’s holiday guidance says employers decide whether work takes place on a public holiday. It also explains that employees who are required to work and do not attend without a legitimate reason may lose the related pay entitlement. The holiday therefore does not, by itself, guarantee every worker a day off.[1][2]

The Act specifies date adjustments for certain other holidays, including Labour Day and some island-specific observances, but gives no replacement-day rule for Easter Monday. The official list names it as the day after Easter Sunday; the calendar dates move with Easter.[1][2]
