A fixed date and legal status

The 2021 decree amending Burundi’s holiday rules names 1 January as the first day of the new year. It places the date in a list of public holidays that are non-working and paid, giving the day a defined legal status in Burundi’s calendar.[1]

The same decree protects pay for workers on daily, weekly or monthly wages from being reduced because of a listed holiday. Hourly, daily and piece-rate workers are entitled to compensation equal to what they would have earned if they had worked. Workers who do work on a listed holiday are entitled to their regular pay plus compensation for the work performed, with the applicable overtime increase.[1]

New Year’s Day is categorized as a secular holiday on the Ministry of Foreign Affairs’ official list. That classification distinguishes it in the calendar from holidays the Ministry labels Catholic, Christian or Islamic; check with local authorities for information about its cultural or religious meaning in Burundi.[2]

When the date falls on Sunday

If it is considered inappropriate to observe New Year’s Day on a Sunday, the holiday moves to the next working day. This is not an automatic transfer for every Sunday holiday; the rule depends on whether Sunday observance is considered inappropriate.[1]

The decree does not set out a general substitute day when 1 January falls on another day of the week. For practical planning, check official announcements for any exceptional change and confirm arrangements with the specific workplace or service you need.[1]

Check directly with the relevant office, bank, shop, restaurant, attraction or transport provider before making plans.[2]

The legal designation as non-working and paid does not establish that every service closes. The decree addresses compensation for workers who work on listed holidays. For appointments, payments or travel, confirm arrangements in advance rather than assuming a particular service will be available or closed.[1]
