About New Year's Day in Canada

New Year's Day is a federal general holiday on 1 January in Canada. The federal rule applies to eligible employees in federally regulated workplaces; provincial, territorial and individual workplace calendars may use different employment rules.

Place in the federal holiday calendar

The Canada Labour Code includes New Year's Day among ten general holidays. Government guidance explains that eligible employees of federally regulated employers receive the protections attached to those days, including general holiday pay under the Code.

That federal scope matters. It covers sectors governed by federal labour standards, while most Canadian employees work under provincial or territorial standards. A federal holiday listing should therefore not be treated as a universal description of every workplace.

The fixed date and a weekend

New Year's Day is fixed on 1 January. When it falls on a Saturday or Sunday that is not a normal working day, the Code provides a paid holiday on the scheduled working day immediately before or after it for eligible federally regulated employees.

A workplace can also substitute another day when the Code's agreement requirements are met. The date table shows the calendar holiday itself because the exact workplace day can depend on schedules and valid arrangements.

Planning for 1 January

Government offices, transport operators, shops and services publish their own opening arrangements. Some essential and continuous operations remain active, and the Canada Labour Code does not prohibit work on a general holiday.

Confirm travel and appointments with the provider involved. Employees should check the labour jurisdiction, work schedule, collective agreement and employer notice before assuming that a particular weekday is their paid day off.
